SAFETY & USAGE INSTRUCTIONS - READ CAREFULLY BEFORE USE

⚠️ WARNING: FAILURE TO FOLLOW THESE INSTRUCTIONS MAY RESULT IN SERIOUS INJURY, DEATH, PROPERTY DAMAGE, OR FIRE.

INTENDED USE

This product is designed exclusively for outdoor recreational street hockey use on hard surfaces such as asphalt or concrete. Any other use is prohibited and constitutes misuse.

FIRE AND BURN HAZARDS

Sparks generated by this product are HOT and may ignite flammable materials.

  • Outdoor use only
  • Use only on asphalt or concrete surfaces
  • DO NOT USE on or near: wood, grass, gravel, mulch, leaves, dry vegetation, painted surfaces, coated surfaces, indoor flooring, carpets, or any combustible materials
  • Maintain a minimum distance of 6 feet (2 meters) from all people, animals, vehicles, buildings, structures, and flammable materials at all times
  • Never point the stick toward any person or animal
  • Keep away from gasoline, fuels, chemicals, aerosols, vapors, fabrics, paper, and all other flammable or combustible materials
  • DO NOT USE indoors, in garages, on balconies, patios, decks, or in any enclosed or semi-enclosed spaces
  • DO NOT USE during fire bans, red flag warnings, drought conditions, extreme heat, high winds, or when local authorities have issued fire restrictions
  • Sparks may mark, scorch, burn, or permanently damage surfaces
  • User is solely responsible for ensuring safe conditions before and during use

AGE AND SUPERVISION REQUIREMENTS

  • NOT SUITABLE FOR CHILDREN UNDER 8 YEARS OLD
  • Recommended for ages 8 and older
  • Adult supervision required for all users under 14 years of age
  • Adult supervisors must read and understand all safety instructions before allowing use by minors

PERSONAL PROTECTIVE EQUIPMENT

  • Eye protection (safety glasses or goggles) strongly recommended
  • Secure long hair with a tie or band
  • Remove or secure loose clothing, jewelry, accessories, scarves, or any items that may catch on moving parts
  • Wear closed-toe shoes; never use barefoot or in sandals

PRE-USE INSPECTION - MANDATORY

Inspect the product thoroughly before each use. DO NOT USE if any of the following conditions exist:

  • Blade is loose, moves, wiggles, rotates, or is not fully seated in the shaft
  • Blade shows cracks, chips, excessive wear, deformation, or any structural damage
  • Shaft is cracked, split, bent, or shows any signs of structural failure or damage
  • Any component shows signs of melting, burning, discoloration from heat, or unusual odor
  • Any other visible damage, defect, or abnormal condition

If any of these conditions are observed, STOP USE IMMEDIATELY and replace the damaged component before further use.

DURING USE

  • Stop use immediately if you observe unusual heat, smoke, flames, odor, or any abnormal condition
  • Stop use immediately if the blade becomes loose or shifts during play
  • Do not strike hard objects (rocks, metal, curbs) with excessive force
  • Be aware of your surroundings and maintain safe distances at all times
  • Comply with all local laws, fire codes, ordinances, and park regulations

MAINTENANCE AND STORAGE

  • Inspect product before and after each use
  • Replace blade when worn, damaged, or showing signs of deterioration
  • Allow all components to cool completely (at least 30 minutes) before handling, disassembling, or storing
  • DO NOT modify, alter, repair, or attempt to service the product in any way
  • Store in a cool, dry location away from heat sources, flames, direct sunlight, moisture, and flammable materials
  • Keep out of reach of children when not in use

PRODUCT CLASSIFICATION

This is sports equipment designed for recreational use. This is NOT a toy, firework, or pyrotechnic device. Sparks are produced through mechanical friction between embedded materials and hard surfaces. These sparks are hot and may ignite flammable materials.

ASSUMPTION OF RISK

BY PURCHASING, POSSESSING, OR USING THIS PRODUCT, YOU EXPRESSLY ACKNOWLEDGE AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ITS USE, including but not limited to risks of:

  • Personal injury or death
  • Property damage
  • Fire or burn injuries
  • Injury to third parties
  • Any other harm or loss of any kind

You agree that you are solely responsible for using this product safely, responsibly, and in full compliance with these instructions and all applicable laws.

LIMITATION OF LIABILITY AND RELEASE

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

DESROCHERS HOCKEY INC., ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, LICENSORS, DISTRIBUTORS, RETAILERS, SUPPLIERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") SHALL NOT BE LIABLE FOR ANY DAMAGES, INJURIES, LOSSES, OR CLAIMS OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

  • Personal injury, illness, disability, disfigurement, or death
  • Property damage or destruction
  • Fire, explosion, or burn injuries
  • Economic losses, lost profits, or business interruption
  • Direct, indirect, incidental, consequential, punitive, special, or exemplary damages
  • Attorneys' fees, court costs, or other legal expenses

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (INCLUDING NEGLIGENCE, STRICT LIABILITY, BREACH OF WARRANTY, PRODUCT LIABILITY, OR ANY OTHER THEORY) AND EVEN IF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BY USING THIS PRODUCT, YOU RELEASE AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION ARISING FROM OR RELATED TO:

  • Purchase, possession, or use of this product
  • Misuse, abuse, or improper use
  • Failure to follow instructions or warnings
  • Use under prohibited conditions or on prohibited surfaces
  • Product malfunction, failure, or defect
  • Acts or omissions of third parties
  • Any other cause whatsoever related to this product

WARRANTY DISCLAIMER

THIS PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELEASED PARTIES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY RELEASED PARTIES SHALL CREATE A WARRANTY.

STATE-SPECIFIC RIGHTS

Some states do not allow the exclusion or limitation of incidental or consequential damages or implied warranties, so the above limitations may not fully apply to you. This notice gives you specific legal rights, and you may have other rights that vary from state to state.

IMPORTANT: Nothing in this notice is intended to exclude or limit liability that cannot be lawfully excluded or limited, including liability for fraud, willful misconduct, or gross negligence where such exclusion is prohibited by law.

BY PURCHASING, OPENING THE PACKAGE, OR USING THIS PRODUCT, YOU ACKNOWLEDGE THAT:

  3. You release and discharge the Released Parties from all liability as set forth above
